Abstract
The phenomenon of traffic violations by the fire brigade (BPK) and its members in Banjarmasin City(Halim & Sarbini, 2023, p. 119)because Banjarmasin City is not only famous for its floating market tourism and the city of a thousand rivers, the nickname of Banjarmasin City is also famous for its 1000 firefighters (damkar) or what is often called the Fire Brigade (BPK).(Anshari & An'amta, 2025). becomes a complex legal and social issue. The actions of driving at high speed, running red lights, and ignoring traffic signs are often considered normal because emergency situations demand speed in saving lives and property. However, on the other hand, these actions pose potential dangers to other road users and open up space for a dilemma between humanity and law enforcement. This study seeks to examine the practice of traffic violations by members of the Supreme Audit Agency (BPK) in relation to Banjarmasin City Regional Regulation Number 2 of 2023 concerning Fire Prevention, Handling, and Rescue, through a normative legal approach and analysis of maqāṣid shari'ah, especially in the aspect of preserving the soul (ḥifẓ al-nafs).
By integrating Mahfud Junaidi's maqāṣid syarī'ah theory, phenomenological theory, and the principles of good governance, this study found that the violations occurred not only due to emergency needs, but also influenced by weak supervision, a lack of understanding of operational procedures, and minimal legal awareness among BPK members. From the perspective of maqāṣid syarī'ah, rescue actions must be carried out with the principles of justice and benefit to avoid causing harm to other communities. Therefore, there is a need for an evaluation of standard operating procedures, increased training, and strengthened coordination between the BPK and the police to ensure a balance between public safety and effective fire management. This research is expected to provide a conceptual contribution in the development of regional policies that are more responsive, equitable, and in line with sharia values.
